Labor subcontracting and professional subcontracting are common subcontracting methods in the field of construction engineering, but there are significant differences between the two. The following provides a detailed comparative analysis of labor subcontracting and professional subcontracting from multiple dimensions:
1、 Subcontractor and Contract Object
The employer of professional subcontracting is limited to the general contractor, involving three parties: the general contractor, professional subcontractors, and the employer. The contract object is a step-by-step sub project, and the calculation is for project funds, manifested as labor and material contracting.
The employer of labor subcontracting is more flexible, and can be a general contractor or a professional engineering contractor, so it may involve four parties involved. The contract object is the labor service in the project, which is calculated as labor cost, usually manifested as contracting labor but not materials, commonly known as "clearance".
2、 Conditions and Scope of Responsibility
The professional subcontracting contract must be approved by the employer, and the professional subcontractor must hold the corresponding professional contracting enterprise qualification. In terms of the scope of responsibility, the professional subcontractor and the general contractor shall bear joint and several liability to the employer for the subcontracted project and its quality. But professional subcontractors cannot subcontract again and can only subcontract labor operations.
Compared to professional subcontracting, labor subcontracting contracts do not require the consent of the employer. The labor contractor is only responsible to the labor contractor for the labor operations they provide, and does not directly assume responsibility to the general contractor. However, labor contractors are also not allowed to subcontract labor operations again.
In summary, there are significant differences between labor subcontracting and professional subcontracting in terms of subcontracting subject, contract object, conditions, and scope of responsibility.
